About Us. NKM Constructions is a family-owned, insured, and bonded
interior architecture and construction firm based in Indiana. We turn your vision into reality with
meticulous finishing, punctual delivery, and clear communication. Our services include General Contracting,
Architectural/Engineering, HVAC, Painting, Flooring, Electrical Installation, and more.
1) Estimates & Proposals
Written estimates are based on the information available at the time and are valid for the period stated on the proposal.
Unless otherwise noted, estimates exclude hidden conditions, hazardous material abatement, utility upgrades, and third-party fees.
A detailed scope of work, pricing, timeline expectations, and payment schedule will be provided prior to contract signing.
2) Contracts, Scope & Changes
Work commences only after a written contract is executed by both parties.
Any change to scope, materials, finishes, or schedule requires a written change order approved by the client and may affect price and timeline.
Client is responsible for timely design selections (colors, fixtures, finishes). Delays in selections may extend timelines.
3) Scheduling & Project Access
Start dates are scheduled upon receipt of the initial deposit and signed contract.
Client agrees to provide reasonable site access during normal working hours and a safe work environment (clear pathways, utilities available, pets secured, etc.).
Weather, supply chain conditions, and inspection availability may impact schedule; NKM will communicate updates proactively.
4) Payments & Billing
Payment milestones and amounts are specified in the contract or proposal.
Invoices are due upon receipt unless otherwise stated. Late payments may pause work and may accrue late fees as outlined in the contract.
Accepted payment methods are listed in the contract or invoice.
5) Non-Refundable Deposit Policy
Before entering into a service agreement, our company provides every client with a comprehensive review process
to ensure full understanding and approval of the project scope, pricing, and terms. Clients are encouraged to
review all details carefully and request any clarifications before signing.
Once the contract is signed, our team immediately begins preparatory work — including project scheduling,
material procurement, administrative coordination, and labor allocation. Because these commitments and costs
begin right away, the initial deposit is non-refundable.
The deposit amount secures your project start date and covers initial administrative and material preparation expenses.
If a client chooses to cancel the project after signing the contract, this deposit will not be refunded under any circumstances.
6) Materials, Lead Times & Substitutions
Lead times for materials and equipment are estimates from suppliers and may change.
If specified items become unavailable, NKM may recommend comparable substitutions for client approval.
Client-provided materials must meet code, be on site when needed, and be free of defects; NKM is not responsible for delays or issues arising from client-provided items.
7) Site Conditions & Unforeseen Issues
Hidden or latent conditions (e.g., structural, electrical, plumbing, HVAC, mold, pests, asbestos) discovered during work will be disclosed with recommended remedies and may require change orders.
Repair or remediation of code violations or unsafe conditions not visible at estimate time will be billed as additional work.
8) Permits, Licensing & Safety
NKM is insured and bonded and holds applicable licenses for the services provided in Indiana or will retain properly licensed subcontractors as needed.
Unless otherwise specified, NKM will obtain required building permits and schedule inspections for the contracted scope. Permit fees are the client’s responsibility unless stated otherwise.
NKM follows OSHA and local safety guidelines; the site must remain free of non-authorized occupants in active work areas.
9) Subcontractors
NKM may engage qualified subcontractors (e.g., licensed electricians, plumbers, HVAC technicians) to perform portions of the work.
All subcontractors are managed by NKM and are required to meet our quality, insurance, and safety standards.
10) Workmanship Warranty
NKM stands behind its workmanship. Specific warranty terms and durations are defined in your contract.
Manufacturer warranties for materials or equipment are passed through to the client where applicable.
Warranty excludes normal wear and tear, misuse, neglected maintenance, or alterations by others after project completion.
11) Communication & Approvals
Each project will have a designated NKM point of contact. Clients agree to provide timely decisions and approvals to keep the project on schedule.
Key decisions (layout, structural changes, custom orders) must be confirmed in writing (email, client portal, or signed change order).
12) Photography, Marketing & Privacy
With client permission, NKM may photograph work progress and completed spaces for quality control and portfolio purposes. Personal identifying information will not be disclosed.
Client data provided to NKM (contact details, project information) is used solely for delivering services and communicating about the project, consistent with our privacy practices.
13) Cancellations & Refunds
Clients may cancel prior to contract signing without obligation.
After signing, the Non-Refundable Deposit Policy applies. Custom-ordered materials may be non-returnable or subject to restocking fees.
If NKM must cancel due to circumstances beyond control, deposits for uncommitted costs will be reconciled fairly; custom orders already placed will be handled per supplier policies.
14) Force Majeure
NKM is not liable for delays or non-performance caused by events beyond reasonable control, including but not limited to
extreme weather, natural disasters, labor disputes, pandemics, governmental actions, or supply chain disruptions.
15) Limitation of Liability & Governing Law
NKM’s total liability arising out of the project is limited to the amounts paid for the specific portion of work giving rise to the claim, to the fullest extent permitted by law.
These terms are governed by the laws of the State of Indiana. The parties agree to good-faith negotiation, and if necessary, mediation prior to litigation.
16) Client Acknowledgment
By signing the contract or approving work to proceed, the client acknowledges that they have read, understood, and agree to
these policies, including the Non-Refundable Deposit Policy, and the terms stated in the project contract and proposal.
